1. Who you are contracting with
goando is operated by Mark Creighton, an individual sole proprietor based in the United States ("goando", "we", "us"). By creating an account or using goando (the "Service"), you agree to these Terms & Conditions.
2. Acceptance
By continuing to use the Service you accept these terms. If you do not agree, do not use the Service. You must be of legal age in your jurisdiction to enter into this agreement, and if you use goando on behalf of an organization, you confirm you have authority to bind that organization.
3. What goando does
goando is a trip-planning tool that lets you build multi-leg itineraries, track costs and quotes, store lodging and transport details, generate AI-assisted suggestions, and share trips with collaborators. Features may change over time.
4. Your account
You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly if you suspect unauthorized access.
5. Acceptable use
You agree not to:
- Use the Service unlawfully, or to send spam, malware, or fraudulent content.
- Infringe anyone's intellectual property or privacy rights.
- Interfere with, probe, scrape, or attempt to compromise the security or integrity of the Service.
- Reverse engineer, resell, or redistribute the Service or circumvent technical limits.
- Use the AI features to generate illegal content, hate speech, deepfakes, malware, or content that violates a third party's rights. You are responsible for your prompts, for verifying the accuracy of any AI output, and for how you use it. AI outputs can be inaccurate and are not a substitute for professional advice (legal, medical, financial, or travel-safety).
6. Intellectual property
We retain all rights, title, and interest in the Service, including its software, design, and branding. You retain ownership of the trip content you enter. You grant us a limited licence to host and process your content solely to provide the Service to you and your collaborators. We may remove content that we reasonably believe violates these terms and, in the case of repeated infringement, suspend or terminate the responsible account.
7. Plans, payments, and billing
goando offers a free tier, a paid goando Pro subscription ($9.00 USD per month or $79.00 USD per year), and a one-time goando Trip PDF Unlock ($20.00 USD). Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, subscription renewals, cancellations, and refund mechanics are governed by Paddle's Buyer Terms. Taxes may apply and will be calculated at checkout.
Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel any time from your account or the Paddle customer portal; access continues through the end of the paid period. See our Refund Policy for refund details.
8. Third-party links and affiliates
goando displays links to third-party travel providers (for example, Expedia). Some of these are affiliate links, meaning we may earn a commission if you make a purchase through them at no extra cost to you. We are not responsible for the content, availability, or practices of third-party sites.
9. Service availability and warranties
We work hard to keep goando running, but we do not guarantee uninterrupted or error-free service. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amount you paid to us (via Paddle) in the twelve (12) months preceding the event giving rise to the claim, or USD 100 if greater. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability that cannot be limited under applicable law (such as liability for fraud, death, or personal injury caused by negligence).
11. Indemnity
You agree to indemnify and hold us harmless from third-party claims arising out of your content, your use of the Service in violation of these terms, or your violation of applicable law.
12. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service and delete your account at any time. On termination, your access to the Service ends; we may retain data as required by law or as described in our Privacy Notice.
13. Changes to these terms
We may update these terms from time to time. Material changes will be communicated in-app or by email. Your continued use of the Service after changes take effect constitutes acceptance.
14. Governing law
These terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in South Carolina, unless applicable consumer-protection law requires otherwise.
